Medically assisted dying now available for individuals who are not at death’s door

In a recent case, the Quebec Supreme Court declared provisions in the Medically Assisted Suicide legislation to be in contravention of the Charter. The Court found the requirement that individuals eligible for MAID have their natural death be “reasonably foreseeable” and that they be “at the end of their life” to infringe the Plaintiff’s rights to life liberty and security under section 7 of the Charter and their right to equality under section 15 of the Charter.
