Honest Performance Now Underpins Freedom of Contract

In the case of Bhasin v. Hrynew, 2014 SCC 71, the Supreme Court identified an “organizing principle” of good faith in contract law that parties cannot contract out of.  Honest performance applies to formation and performance of all contracts.
